Letter to Telegraph 11/12/16

SIR – It is not true that the judges in the Supreme Court hearing were asked to “rule on whether the Brexit-backing voters or Remain-backing MPs should have greater authority” (Leading Article, December 4).

The President of the Supreme Court in his opening remarks, stated that “wider political questions are not the subject of this appeal. This appeal is concerned with legal issues”.

Mishcon de Reya, representing Gina Miller, who brought the case, argues that “It is up to Parliament to give the (advisory) decision of the British public the force of law. Article 50 simply cannot be invoked without a full debate and vote in Parliament”.

The case is about whether we want to preserve parliamentary democracy and remain subject to the rule of law.
